These Terms and Conditions ("Terms") govern your access to and use of the AzukAgri mobile application ("App") and website ("Website") https://www.azukagri.in/ (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

1. Use of the Services

  • You must be at least 18 years old to use the Services.
  • You are solely responsible for your activity on the Services and for any content you post or upload.
  • You agree not to use the Services for any illegal or unauthorized purpose.
  • You agree not to violate any applicable laws or regulations.
  • You agree not to interfere with or disrupt the Services.
  • You agree not to impersonate any person or entity.
  • You agree not to collect or store any personal information about other users without their consent.

2. User Content

  • You retain all ownership rights to the content you post or upload to the Services ("User Content").
  • By posting or uploading User Content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and distribute such User Content in connection with the Services.
  • You are solely responsible for the accuracy and completeness of your User Content.
  • You represent and warrant that you have all necessary rights and permissions to post or upload User Content to the Services.

3. Transactions between Users

  1. We are a platform that provide classifieds between users. We are not a party to any transactions between users.
  2. This means we connect buyers and sellers but are not involved in the actual sale or purchase of any listed items.
  3. You are solely responsible for any transactions you enter into with other users.
  4. We are not responsible for any loss or damage arising from transactions between users, including but not limited to:
    • Item description inaccuracies or improper information about cattle
    • Defective or malfunctioning items
    • Non-delivery of items
    • Payment disputes

4. Disclaimers

  • THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
  • WE DO NOT WARRANT THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE.

5. Limitation of Liability

  1. WE WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:
    • YOUR USE OF THE SERVICES.
    • THE CONDUCT OF OTHER USERS OF THE SERVICES.
    • ANY CONTENT OBTAINED FROM THE SERVICES.
    • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR INFORMATION.
    • TRANSACTIONS BETWEEN USERS, INCLUDING BUT NOT LIMITED TO ITEM DESCRIPTIONS, DELIVERY, PAYMENT, OR OWNERSHIP.

6. Indemnity

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or in connection with your use of the Services or your violation of these Terms.

7. Termination

We may terminate or suspend your access to the Services at any time, for any reason, with or without notice.

8. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of the State of Maharashtra, without regard to its conflict of laws principles.
  • Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in India, Maharashtra.

9. Entire Agreement

These Terms constitute the entire agreement between you and us with respect to your use of the Services.

10. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

11. Waiver

Our failure to enforce any provision of these Terms shall not be construed as a waiver of such provision or any other provision of these Terms.
